Acceptable Use Policy


Welcome to TechTo Networks. This Acceptable Use Policy ("AUP") outlines acceptable practices and prohibited uses of the services offered by TechTo Networks ("we," "our," "us"), including Bulk SMS, WhatsApp Business API, Google RCS, and DLT registration solutions (collectively, the "Services"). By accessing our website or using our Services, you agree to comply with this AUP. This AUP applies to all users of our Services and to any business or entity on whose behalf a user accesses our Services; you confirm that you are at least 18 years of age and authorized to act on behalf of the business or organization for which you use the Services. Violations may result in warnings, rate-limiting, suspension, or termination of your access to our Services, as described in Section 6.

1. Prohibited Uses

You agree not to use TechTo Networks' Services for any of the following:

Unlawful Activity. Any activity that violates local, state, national, or international law, including fraudulent, deceptive, or misleading practices. This includes, without limitation, financial scams such as fake loan offers or crypto and lottery fraud, impersonation of banks, government bodies, or law enforcement, and phishing attempts disguised as legitimate communications.

Spam or Unauthorized Communications. Sending unsolicited bulk messages via SMS, WhatsApp, RCS, or any other channel without valid recipient consent. This includes failing to comply with applicable anti-spam and telecom regulations, including DLT regulations under TRAI, the National Do Not Call (NDNC/DND) registry framework, and, where relevant to your business, international regulations such as GDPR or CAN-SPAM.

Harmful or Malicious Activity. Uploading, distributing, or transmitting viruses, malware, or other harmful code, or conducting phishing, hacking, denial-of-service attacks, or any activity intended to compromise the security, integrity, or privacy of any individual, system, or network, including our own infrastructure.

Infringing Content. Uploading or transmitting content that violates any third party's intellectual property rights, privacy rights, or other legal rights.

Misrepresentation. Falsifying or misrepresenting your identity, business affiliation, or the sender identity (header/sender ID) associated with any message sent through our platform.

Illegal or Restricted Products and Services. Promoting or selling illegal products, services, or substances, including drugs, weapons, or counterfeit goods, or products restricted under Indian advertising and telecom regulations.

Adult or Objectionable Content. Transmitting sexually explicit content, hate speech, content that harasses or threatens any individual, or content that promotes violence or discrimination.

2. Content and DLT Compliance Guidelines

Any content distributed via our platform must comply with the following:

Legality and Accuracy. All content must comply with applicable telecommunications, data protection, and consumer protection law, and must be accurate and not misleading.

Template and Category Matching. Message content must match the category (promotional, transactional, service-implicit, or service-explicit) and exact template registered against your DLT header. Sending content that does not match your registered template category or wording — for example, sending promotional content under a transactional-registered template — is a violation of this AUP and applicable TRAI regulations, and may result in your DLT header being blacklisted independent of any action we take. You acknowledge that DLT header blacklisting resulting from your own non-compliance is your responsibility, and TechTo Networks bears no liability for consequences arising from such action.

Consent. You must obtain and be able to demonstrate valid, explicit consent from recipients before sending any message, and must honor opt-out or DND/NDNC requests promptly, in accordance with applicable law and our Terms and Conditions.

3. Security and Privacy

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for the security of any data transmitted through our platform. You must report any suspected unauthorized access, security breach, or data compromise to us immediately at the contact details in Section 9.

4. Monitoring and Investigation

TechTo Networks reserves the right, but does not undertake any obligation, to monitor account activity, message content, and delivery logs for the purpose of investigating suspected violations of this AUP, responding to regulatory or third-party complaints, or ensuring platform security. Any such review is conducted solely for compliance and security purposes and is handled in accordance with our Privacy Policy and applicable data protection law, including the Digital Personal Data Protection Act, 2023.

5. Fair Use

TechTo Networks reserves the right to impose reasonable usage limits, rate limits, or throttling to prevent abuse and maintain service quality for all users. Unusually high or anomalous usage patterns inconsistent with your registered use case may result in temporary restrictions pending review.

6. Enforcement and Remedies

Where we determine that a violation of this AUP has occurred, we may take action proportionate to the severity and history of the violation, including:

Issuing a warning and requesting corrective action within a specified timeframe; applying rate limits or temporary restrictions to the affected account; suspending access to our Services without prior notice, particularly for serious violations such as fraud, malicious activity, or repeated non-compliance; terminating your access to our Services entirely, in accordance with our Terms and Conditions; reporting unlawful activity to TRAI, DLT platform operators, law enforcement, or other relevant regulatory bodies; and pursuing any other legal or contractual remedies available to us, including recovery of costs or penalties incurred as a result of your violation.

Suspension or termination under this AUP does not entitle you to a refund and does not relieve you of any outstanding payment obligations, in accordance with our Refund & Cancellation Policy and Terms and Conditions. You agree to indemnify and hold TechTo Networks harmless from any claims, penalties, or losses arising from your violation of this AUP.

7. Reporting Abuse

If you are a recipient of unsolicited or abusive messages sent via our platform, or if you become aware of a violation of this AUP, please report it to us at the contact details below with as much detail as possible, including sender ID or header, message content, and date and time received. We investigate all reports of abuse and aim to acknowledge valid reports within 3 business days.

8. Governing Law and Severability

This AUP is governed by the laws of India, and any disputes arising from or relating to this AUP shall be subject to the exclusive jurisdiction of the courts of Thiruvananthapuram, Kerala. If any provision of this AUP is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

9. Changes to This AUP

TechTo Networks may update this AUP at any time. Changes will be posted on our website with an updated "Last Updated" date, and continued use of our Services following any changes constitutes acceptance of the revised policy.
